A trademark is a sign capable of being represented graphically in the form of an image, logo, name, word, letters, numbers, color arrangement, in 2 (two) dimensions and/or 3 (three) dimensions, sound, hologram, or a combination of 2 (two) or more of these elements to distinguish goods and/or services produced by persons or legal entities in trading goods and/or services.

A mark used on goods traded by a person or several people jointly or a legal entity to distinguish them from other similar goods.

  • An identification mark to distinguish the production results produced by a person or several people jointly or a legal entity from the production of other people or other legal entities.
  • Promotional tool, so promoting the product is enough by mentioning the Trademark.
  • Guarantee of the quality of the goods.
  • Indication of origin of goods/services produced.
  • Evidence for the owner entitled to the registered Trademark
  • Basis for rejection of a Trademark that is the same in its entirety or essentially the same applied for registration by another person for similar goods/services
  • Basis to prevent other people from using the same Trademark in its entirety or essentially the same in circulation for similar goods/services.
  • Contrary to state ideology, legislation, morality, religion, decency, or public order
  • Is the same as, relates to, or only mentions the goods and/or services for which registration is requested

A registered Trademark receives legal protection for a period of 10 years from the date of receipt of the Trademark registration application and can be extended.

  • Has similarities in essence or in its entirety with a Trademark owned by another party that has been registered earlier for similar goods and/or services
  • Has similarities in essence or in its entirety with a well-known Trademark owned by another party for similar goods and/or services
  • Has similarities in essence or in its entirety with a well-known Trademark owned by another party for dissimilar goods and/or services provided that it meets certain requirements stipulated further by government regulations
  • Has similarities in essence or in its entirety with a known geographical indication
  • Is or resembles a famous person's name, photo, or the name of a legal entity owned by another person, except with written consent from the entitled party
  • Is an imitation or resembles the name or abbreviation, flag, coat of arms or symbol or emblem of a state or national or international institution, except with written consent from the competent authority
  • Is an imitation or resembles an official sign or seal or stamp used by the State or a government institution, except with written consent from the competent authority.
